Customer Privacy Policy
A. Definition
Personal Data is data about an individual who is identified or can be identified individually or in combination with other information either directly or indirectly through an electronic or non-electronic system. Personal Data that is processed includes Personal Data that you have and will provide to Bank Banten.
Personal Data that is processed is Personal Data that you have and will provide to Bank Banten.
B. Scope of Personal Data
Personal Data collected by Bank Banten in connection with the service products/services used by Customers. Such Personal Data includes Specific Personal Data and General Personal Data as regulated in the provisions of Law No. 27 of 2022 concerning Personal Data Protection:
- Specific Personal Data, including:
- Biometric Data such as: Fingerprints, Face and Record;
- Personal Financial Data;
- Other Data in accordance with applicable provisions.
- General Personal Data, including:
- Full name;
- Gender;
- Citizenship;
- Religion;
- Marital status;
- Address;
- Place and date of birth;
- Mother’s maiden name;
- Occupation;
- Personal data combined to identify a person, such as mobile phone number and IP Address.
C. Purpose of Personal Data Processing
Bank Banten has the following purposes in processing Personal Data that has been obtained or collected by Bank Banten:
- To implement the Know Your Customer (KYC) principle and provide personalization to Bank Banten Customers in using product and/or service services provided by Bank Banten;
- Implement the Customer Due Diligence (CDD) principle in accordance with applicable laws;
- Compliance with applicable laws including but not limited to Anti-Money Laundering, Prevention of Terrorism Funding, and Prevention of Proliferation of Weapons of Mass Destruction Funding (APU-PPT and PPPSPM);
- Resolve any problems related to Customer access to product and/or service services available at Bank Banten;
- Follow up on any complaints from Customers and Other Parties who cooperate on product and/or service services available at Bank Banten;
- Evaluation, improvement, and/or updating of product and/or service features available at Bank Banten from time to time;
- Offering advertisements/promotions or marketing of banking products and/or services or other parties cooperating with Bank Banten in organizing loyalty programs, to customers such as gifts, sweepstakes, and others; and
- Other purposes as long as permitted or required by applicable laws.
D. Types of Personal Data
Bank Banten as a BUMD is fully aware that it is important for you as a customer to know what categories and types of your Personal Data can be processed. The types of personal data processed by Bank Banten are relevant data according to the processing purposes of each service product/service which include:
- Personal profile identification data, namely full name, Population Identification Number (NIK) for Indonesian Citizen (WNI) and Foreign Citizen (WNA) ID cards, Taxpayer Identification Number (NPWP)/Tax Identification Number (TIN), data on immigration documents, gender, citizenship, place and date of birth, alias/nickname, religion, voice recording, image recording, photo, signature form (wet and/or electronic), and/or biometric data;
- Correspondence data, namely address according to ID card, address and domicile status, electronic mail address (email), telephone/mobile phone and fax number;
- Education and employment data, namely education level, type of employment, field of business, position, division, year of employment/business, name of company/agency where you work, address of place of employment, employment status, and names, positions, and telephone numbers of co-workers;
- Family data, namely marital status, name of spouse, number of children, and number of dependents;
- Financial data, namely name of account holder, account number, source of income, amount of monthly/annual income, amount of monthly/annual expenses, transaction data, credit/financing data, data related to assets, data related to collateral, and tax data) and service data from other financial services that you receive (i.e. insurance and custodian);
- Data related to personal preferences, namely communication preferences.
Personal Data processed by Bank Banten is received directly from you.
E. Legality of Personal Data Processing
Personal Data processing is carried out as long as Bank Banten has fulfilled one or more of the following processing bases:
- Bank Banten has explicitly and legally obtained your consent;
- Bank Banten exercises its rights and obligations based on an agreement with you;
- Bank Banten also needs to exercise authority or fulfill obligations based on laws and regulations/orders of authorized agencies;
- Bank Banten needs to fulfill your interests;
- Bank Banten needs to carry out tasks in the context of public interest and/or public services;
- Bank Banten needs to fulfill other legitimate interests, while still paying attention to the balance between Bank Banten’s interests and your rights.
F. Control and Transfer of Personal Data
In processing your Personal Data, Bank Banten may involve a third party as a joint controller and/or processor of your Personal Data both inside and outside Indonesia. In such cases, Bank Banten will protect your personal data in accordance with applicable laws and regulations.
If Bank Banten transfers your Personal Data outside Indonesia, Bank Banten will reasonably ensure that the destination country of the transfer has a level of protection for Personal Data (Customers) that is equivalent (or higher) than the protection of Personal Data in Indonesia.
G. Your Rights as a Personal Data Subject
Bank Banten is very aware that your Personal Data is its most important asset. Therefore, here we inform you of the rights you have as a Personal Data Subject:
- Right to Information and Access
You have the right to obtain information regarding the identity of the party requesting your Personal Data and the purpose of the request and access to a copy of your Personal Data. Bank Banten will provide access to this information through official Bank Banten facilities, such as Bank Banten branches, in accordance with the provisions of laws and regulations and Bank Banten policies.
You understand that in the event that you request a copy of your Personal Data information and/or details of the processing of your Personal Data, you may be charged a fee by Bank Banten.
- Right to Data Correction
You have the right to complete, update, and/or correct incorrect or inaccurate Personal Data that has been stored at Bank Banten in order to update your Personal Data.
- Right to Obtain, Use and/or Send Personal Data to Other Parties
You have the right to obtain, utilize, or provide your Personal Data held by Bank Banten to third parties, as long as the communication system used by Bank Banten and the Third Party in question is secure.
- Right to Terminate Processing, Delete and/or Destroy Personal Data
You have the right to terminate the processing, delete and/or destroy your Personal Data by informing Bank Banten. You agree to give Bank Banten time to terminate the processing, delete and/or destroy your Personal Data in accordance with applicable laws and regulations or Bank Banten’s data retention policy. You may submit a written request to the Bank Banten Branch Office that created the account to exercise the right to terminate the processing, deletion and/or destruction of the Personal Data.
To be understood, termination of processing, deletion and/or destruction of the Personal Data may affect Bank Banten’s ability to provide products, services, and services to you as well as the contractual relationship that has been made between Bank Banten and you or between Bank Banten and other third parties, including possibly resulting in the cessation of the services you receive and/or the termination of one or more of your agreements with Bank Banten. The process of terminating the processing, deletion and/or destruction of Personal Data may only be carried out as long as your rights and obligations to Bank Banten have been fulfilled.
Bank Banten may delete and/or destroy your Personal Data from the system (right to erase) so that the data no longer identifies you, except for:
- Interests of national defense and security;
- Interests of law enforcement processes;
- Public interests in the context of state administration; or
- Interests in supervising the financial services sector, monetary, payment systems, and financial system stability carried out in the context of state administration.
- Statistical and Scientific Research Interests.
- Right to Object to the Results of Automatic Processing
You have the right to object to the results of automated processing of your Personal Data that results in legal consequences or has a significant impact on you, including profiling and/or credit scoring.
- Other Rights in Accordance with Laws and Regulations
You as a Bank Banten Customer have the right to submit other rights related to the processing of personal data as long as the rights submitted are in accordance with the provisions of applicable Laws and Regulations.
H. Personal Data Processing Period
Bank Banten will process Personal Data since Bank Banten obtains the basis for processing. Bank Banten will continue to process it as long as you are still using Bank Banten’s products, services, and/or services or in accordance with the provisions of applicable laws and regulations.
Bank Banten may store your Personal Data after you terminate the use of Bank Banten’s products, services and/or services for a period of time required by referring to laws and regulations.
